These Terms of Use apply to this website and its content, owned and operated by HAUTES PERFORMANCES REPRESENTATIONS INC (hereinafter “Javsolutions”). This is an agreement between you and Javsolutions.

Javsolutions owns and operates a website at www.javsolutions.ca (le (“Site”). 

The Site is for informational purposes only and is intended for commercial purposes only.

Each time you use the Site, you signify your unlimited acceptance or reservation that you are bound by this Agreement on your behalf.

The following Terms of Use, and any additional documents and/or terms expressly incorporated by reference (collectively, the “Terms of Use“), govern your access to and use of the Site

The Site may only be used by persons who are of legal age and who can legally enter into binding contracts under the applicable law accessible to all users (hereinafter the “user(s“)). By using or browsing the Site, you agree to abide by these Terms of Use.

Javsolutions reserves the right to modify the Terms of Use and to remove, modify or update all or part of the content of the Site at its sole discretion and without notice.

Security and privacy

These Terms of Use must be read in conjunction with the Privacy Policy of Javsolutions. available on the Site.

By accepting this agreement and each time you use the Site, you consent to the collection, use and disclosure by Javsolutions of your personal information in accordance with the Privacy Policy in its current form. Javsolutions recognizes the importance of your personal information in accordance with its Privacy Policy.  

Javsolutions. recognizes the importance of the confidentiality and sensitivity of your personal information and takes reasonable and appropriate measures to ensure its protection against accidental loss and unauthorized access, use, modification and disclosure.

Javsolutions. cannot, however, guarantee the security of personal information transmitted via its Site and is not responsible for circumventing the privacy settings or security measures contained on its Site. The user assumes all risks related to the use of the Site, the downloading of documents or images from them or the use of hyperlinks contained therein.

To this end, your use of the Site is conditional on all the information provided being correct, up-to-date and complete. By submitting your registration information or by using any interactive feature available on the Site, you consent to all actions taken by. with respect to the information so transmitted, as detailed in Javsolutions’ Privacy Policy.

You are prohibited from attempting to circumvent and violate the security of the Site, including, without limitation: (a) accessing content and data not intended for you; (b) attempting to violate or violate security and/or authentication measures that are not authorized; (c) restricting, disrupting or disabling the service to users, hosts, servers or networks; (d) disrupting network services and otherwise interfering with the ability of the owner of the sites to monitor them; (e) using a robot or any other device, process or automatic means to access the Site for any purpose, including monitoring or copying any material on the Site; (g) introducing viruses or other malicious or technologically harmful material; (h) attacking the Site through a denial-of-service or other attack; or (i) attempting to otherwise interfere with the proper functioning of the Site.

Witness Files

Javasolutions uses cookies on the Site.  (A witness file is a small text file saved to the user’s computer hard disc. This file is harmless and cannot contain viruses.)

  • To analyze visits to the Site, Javsolutions can use the Google Analytics software. The latter uses cookies to record certain user behaviours, including the number of visits to the Site, the path travelled and the duration of the visit. In no case does the witness file identify the user.

The data remain completely anonymous and are only intended to improve the Site according to the needs of its users.

Intellectual property

You understand and agree that the Site and all of its content, features and functionalities belong exclusively to Javsolutions, its licensors or other suppliers of such material and are protected in all their forms by all laws of Quebec, Canada and other countries relating to intellectual property, including applicable copyright laws, trademarks, patents or any other proprietary rights.

The name of Javsolutions, the symbol of Javsolutions and all names, logos, product and service names, designs, images and slogans disseminated on the Site are trademarks of Javsolutions. The use of such trademarks, unless expressly permitted, constitutes an infringement or violation of the rights of the owner and may violate federal or other laws and could expose the infringer to legal action.

No one may sell or modify, for public or commercial purposes, the texts, videos, images or other content made available on the Site.

The texts, videos, images or other content, expressed or made available on the Site may also be used for strictly personal and educational purposes subject to the following conditions:

  • Your computer and browser may temporarily store or cache copies of the items you viewed.
  • a reasonable number of copies for personal use only may be printed with all proprietary notices intact and visible, which may only be used for personal, non-commercial and lawful use and not for reproduction, publication or distribution of any kind in any medium;
  • only one user copy may be downloaded with all proprietary notices intact, for your personal and non-commercial use, provided that you agree to be bound by our end-user license agreement for such downloads.

Site Monitoring, Suspension and Termination

Javsolutions reserves the right at its sole discretion and without notice to:

  • take appropriate action, including but not limited to referral to law enforcement or regulatory authorities, or notify any affected party of any unlawful or unauthorized use of the Site or its content;
  • terminate or suspend access to all or any part of the Sites for any reason, including, without limitation, any violation of these Terms of Use.

Geographical Restrictions

The owner of the sites is based in the province of Quebec in Canada. We provide access to the Site for use only by persons located in Canada. This Site is not intended to be used in a jurisdiction where its use is not permitted. If you access the Site from outside Canada, you do so at your own risk and are responsible for compliance with local laws in your jurisdiction.

Exclusion of guarantees

THE CONTENT OF THE SITE, INCLUDING CONTENT PROVIDED BY THIRD PARTIES, INCLUDING OTHER USERS OR LICENCED THIRD PARTIES, WHICH MAY BE FOUND ON THE SITE, AS WELL AS CONTENT ACCESSIBLE THROUGH THE HYPERLINKS, IS DISSEMINATED FOR PURELY INFORMATIONAL PURPOSES.

JAVSOLUTIONS CANNOT GUARANTEE OR REPRESENT UNINTERRUPTED ACCESS TO THE SITE AND CANNOT BE HELD LIABLE FOR ANY DAMAGE RESULTING DIRECTLY OR INDIRECTLY FROM THE USE OR PERFORMANCE OF THE SITE, THEIR FEATURES OR THEIR CONTENT.

JAVSOLUTIONS CANNOT WARRANT OR REPRESENT THAT FILES OR DATA AVAILABLE FOR DOWNLOAD FROM THE INTERNET OR ITS SITE WILL BE FREE OF VIRUSES OR OTHER DESTRUCTIVE CODE. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR GROSS AND/OR WILFUL MISCONDUCT, JAVSOLUTIONS, ITS DIRECTORS, AFFILIATES, AGENTS, LICENSORS, EMPLOYEES, PROVIDERS OR INTERNET SERVICE PROVIDERS, CANNOT BE HELD LIABLE FOR ANY DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM YOUR USE OR PERFORMANCE OF THE SITE, THEIR FEATURES OR CONTENT. THE SITE IS PROVIDED “AS IS” AND ACCORDING TO ITS AVAILABILITY.

JAVSOLUTION SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY ANY DISRUPTION OF SERVICE, VIRUS OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT COULD INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER MATERIAL OWNED BY YOU AS A RESULT OF YOUR USE OF THE SITE OR ANY SERVICE OR MATERIAL FOUND OR OBTAINED BY THE SITE OR YOUR DOWNLOADING OF MATERIAL PUBLISHED THEREON OR ON ANY WEBSITE LINKED THERETO.

Compensation

To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless Javsolution and its directors, affiliates, agents, licensors, employees, suppliers, or internet service providers from and against any claim, liability, damages, judgments, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or in connection with your breach of these Terms of Use or your use of the Site.

Applicable laws and jurisdiction

The Site and these Terms of Use are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada that apply. Any dispute arising out of the use of the Site or the interpretation or application of the Terms of Use will be subject to the exclusive jurisdiction of the courts of the Province of Quebec and/or the Federal Court of Canada before the judicial district of the head office of Javsolutions, namely Montreal.
